Terms of Service
These terms are the agreement between you and PecanAi LLC ("we", "us"), a United States limited liability company, covering your use of Soloist — the website at soloisthq.com and the apps served from perchbio.com, countertill.com, hearthrooms.com and reelwharf.com. Using Soloist means you accept them.
1. Your account
You need an account to use most of Soloist. Keep your password to yourself; you're responsible for what happens under your account. Tell us promptly if you think someone else has got into it. You must be at least 13, and old enough in your country to enter a contract.
2. What you get
Soloist is sold in four collections — Reach, Commerce, Community and Studio. A collection subscription unlocks every app in that collection, including apps added to it later. It does not unlock apps in a collection you haven't bought.
Only some apps exist today. We describe on this site which are live and which are still being built, and we deliberately do not publish launch dates. Buy a collection for what it contains today. Nothing on this site is a promise that a particular unreleased app will ship, or ship by any date.
3. Your content stays yours
You own everything you upload or create in Soloist. You give us only the permission we need to run the service: to store your content, process it, and display or transmit it where you've asked us to (for example, publishing your public link page). That permission ends when you delete the content or your account, apart from copies sitting in backups until they expire.
You promise you have the right to the content you put in, and that it doesn't infringe someone else's rights.
4. What you may not do
- Break the law, or use Soloist to help someone else break it.
- Send spam, or use the publishing tools for unsolicited bulk messaging.
- Upload malware, or content that infringes copyright or trademarks.
- Post sexual content involving minors, or content that incites violence or harassment.
- Attack the service — scraping at abusive rates, probing for holes, circumventing limits, or reselling access.
We can suspend or close an account that does these things. Where we reasonably can, we'll warn you first and explain why.
5. Payment
Prices are shown on the pricing page and charged in US dollars through Stripe. Subscriptions renew automatically — monthly plans each month, annual plans each year — until you cancel. Cancelling stops the next renewal; you keep access until the end of the period you've already paid for. Refunds are covered by our refund policy, which forms part of these terms.
We may change prices. Existing subscribers get at least 30 days' notice by email before a change affects their renewal, and can cancel instead.
6. Availability
We work to keep Soloist up, but we do not offer a uptime guarantee or service credits. We may change, pause or retire features. If we retire an app or a whole collection you're paying for, we'll give you reasonable notice, a way to export your content, and a pro-rata refund for the part of the term you paid for and won't receive.
7. Ending it
You can close your account whenever you like from the account page or by emailing us. We can terminate for a material breach of these terms, or with 30 days' notice if we shut the service down. Export your content before you go — after deletion we can't get it back for you.
8. Disclaimers
Soloist is provided "as is". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted or error-free. Some jurisdictions don't allow these exclusions, in which case they don't apply to you.
9. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or lost data. Our total liability for any claim relating to Soloist is capped at what you paid us in the twelve months before the claim arose. Nothing here limits liability for fraud, or for anything that can't be limited by law.
10. Indemnity
If someone brings a claim against us because of content you put into Soloist or because you broke these terms, you'll cover our reasonable costs in dealing with it.
11. Changes to these terms
We'll post updates here with a new date. For material changes we'll email account holders at least 30 days ahead. Carrying on using Soloist after that means you accept the new terms.
12. Governing law and disputes
These terms are governed by the laws of the state in which PecanAi LLC is formed, without regard to its conflict-of-law rules, and by US federal law where it applies. Disputes go to the state or federal courts sitting in that state, and both of us consent to that. If you're a consumer, this doesn't strip you of the protections or the courts your own country's law guarantees you.
Before filing anything, please email us — nearly everything is faster to fix that way.
13. The rest
These terms, plus the privacy policy and refund policy, are the whole agreement between us. If a court strikes part of them, the rest stands. Not enforcing something once doesn't waive it. You can't transfer this agreement without our consent; we can transfer it if the business is sold, and we'll tell you if that happens.
